Terms of Service

1. Acceptance of Terms

By accessing our website, creating an account, or purchasing any service from Hoststack, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Acceptable Use Policy (collectively, the "Agreement"). If you do not agree to any part of this Agreement, do not use our services.

These Terms constitute a legally binding contract between you and Hoststack. "You" refers to the individual or legal entity accessing our services.

2. Our Services

Hoststack provides the following services:

  • Shared web hosting (cPanel, DirectAdmin, Plesk)
  • Cloud and WordPress hosting
  • Virtual Private Servers (VPS) — shared vCore and dedicated core (VDS)
  • Windows VPS with Remote Desktop Protocol
  • Game server hosting (Minecraft, FiveM, CS2, Rust, Valheim, ARK, DayZ, Palworld and others)
  • Business email hosting
  • Reseller hosting with WHM/cPanel
  • Domain name registration and management

Service specifications shown on our website are accurate at time of purchase and are subject to change with reasonable notice. We reserve the right to modify, suspend or discontinue any service with 30 days' notice where reasonably practicable.

3. Eligibility

You must be at least 18 years of age to purchase our services. By creating an account you represent that you are 18 or older and have the legal capacity to enter into a binding contract. If you are purchasing on behalf of a company or organisation, you represent that you have authority to bind that entity to this Agreement.

4. Your Account

  • You are responsible for maintaining the confidentiality of your account password and all activity under your account.
  • You must notify us immediately at [email protected] of any suspected unauthorised access.
  • You must provide accurate, current and complete registration information and keep it updated.
  • Accounts are non-transferable without our prior written consent.
  • We may suspend accounts where we reasonably suspect fraudulent activity or identity misrepresentation.

5. Payment & Billing

  • All services are prepaid. Invoices are generated and due before the service billing period begins.
  • Prices are in Indian Rupees (INR) and inclusive of applicable GST unless otherwise stated.
  • GST-compliant invoices are issued automatically for every payment.
  • Accepted payment methods include UPI, credit/debit card, net banking and IMPS as available in the client portal.
  • Services not paid by the due date will receive a 3-day grace period, after which they may be suspended. Suspended services not paid within 14 days of suspension may be terminated and data deleted.
  • Disputed charges must be raised within 30 days of the invoice date by contacting support.
  • We reserve the right to change pricing with 30 days' advance notice via email. Existing active subscriptions will be honoured at the contracted price until the next renewal.

6. Renewals & Cancellation

  • Services renew automatically on their billing anniversary unless cancelled.
  • Renewal invoices are sent at least 7 days before the due date.
  • You may cancel your service at any time from the client area. Cancellations take effect at the end of the current billing period unless you request immediate cancellation.
  • Cancellation of a service does not automatically entitle you to a refund. Refer to our Refund Policy for details.

7. Refunds

Our refund terms are detailed in our Refund Policy. In summary:

  • Shared hosting plans: 30-day money-back guarantee from first purchase.
  • VPS, VDS, Game VPS, Windows VPS: no refund after provisioning.
  • Game server plans: no refund after provisioning.
  • Domain registrations and renewals: non-refundable.
  • Annual plans: pro-rated refund may be considered within 7 days of purchase at our discretion.

8. Acceptable Use

Your use of Hoststack services is subject to our Acceptable Use Policy. Prohibited activities include but are not limited to:

  • Sending unsolicited bulk email (spam)
  • Hosting malware, phishing, ransomware or attack tools
  • Conducting DDoS, port scanning or network abuse against any host
  • Mining cryptocurrency without prior written consent
  • Hosting or distributing illegal content under Indian or international law
  • Infringing copyright, trademarks or other intellectual property rights

Violation may result in immediate service suspension or termination without refund and may be reported to relevant authorities.

9. Intellectual Property

Hoststack's website, brand, software, documentation and content are owned by or licensed to Hoststack and protected by Indian copyright and intellectual property law. You may not copy, reproduce, distribute or create derivative works without our written permission.

You retain all rights to content you upload or host on our servers. By hosting content with us, you grant Hoststack a limited licence to store, transmit and backup that content solely for the purpose of providing the contracted service.

10. Uptime & Service Level

We target 99.9% network uptime. Our full Service Level Agreement defines uptime calculation methodology, exclusions, and how to claim SLA credits. Downtime due to customer actions, third-party software, scheduled maintenance or force majeure is excluded from uptime calculations.

11. Backups

We provide automated daily backups on eligible hosting plans as a courtesy. However, you are ultimately responsible for maintaining independent backups of all critical data hosted with us. We strongly recommend maintaining off-site backups regardless of your plan. We are not liable for data loss resulting from hardware failure, account termination, or any other cause.

12. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

  • Our aggregate liability to you arising from or related to these Terms shall not exceed the total amount paid by you to Hoststack in the 30 days preceding the event giving rise to the claim.
  • We are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data, revenue, goodwill or business opportunities.
  • We are not liable for service interruptions caused by acts of God, government action, natural disasters, internet infrastructure failures or other events outside our reasonable control.

Nothing in these Terms limits liability for fraud, wilful misconduct, or death or personal injury caused by our negligence.

13. Indemnity

You agree to indemnify, defend and hold harmless Hoststack, its directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your violation of any law or third-party rights; or (c) content or data you host using our services.

14. Termination

Either party may terminate the agreement:

  • By you: Cancel any service from the client portal at any time. Termination takes effect at end of paid period unless immediate cancellation is requested.
  • By us: We may terminate services immediately for AUP violations, non-payment exceeding 14 days post-suspension, or activity harmful to our network or other customers. Where reasonable, we provide 7 days' notice before termination.

Upon termination, your data may be deleted within 30 days. We recommend downloading your data before cancelling.

15. Dispute Resolution

If you have a dispute with Hoststack, please contact our support team first. Most disputes can be resolved quickly through our support channels. If a resolution cannot be reached within 30 days, the matter may be submitted to mediation before either party initiates legal proceedings.

16. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Indian Contract Act, 1872, and applicable consumer protection legislation. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal, India.

17. Changes to These Terms

We may update these Terms at any time. For material changes, we will notify you by email at least 14 days before the change takes effect. Continued use of our services after the effective date of a change constitutes acceptance. If you do not agree to the revised Terms, you may cancel your services before the change takes effect.
